Learn what qualifies as a physical presence and how to add it to your account

What is a Physical Presence?

A physical nexus means your business has a tangible connection to a state that creates a tax obligation.

Common examples include:

  • Physical stores or offices

  • Mailing addresses or warehouses

  • Employees (including remote workers and contractors)

  • Inventory stored in a state

  • Attending trade shows or events in a state

Kintsugi supports all ISO countries (~250+) in the country picker, so please add your physical presence in any countries where you have it.

Also, when adding physical presence, please note that you can have only one record per country + state + category combination. For example, you can't add "Office in California" twice, but you can add "Office in California" and "Remote Employee in California" as separate entries.

Two Ways to Add Physical Presence

There are at least two ways to add Physical Presence in Kintsugi.

  1. Manually via the Kintsugi App. We will discuss this in more detail in the next section. If you have a physical presence in multiple locations or countries, please add them all.

  2. Automatically via payroll/HRIS. Connect a payroll provider (like Deel, Rippling, or Gusto) and Kintsugi will automatically create presence records based on where your employees are located.
